These Terms and Conditions (hereinafter, the “Terms”) govern access to and use of the Diga platform offered by Diga Agentes, S.L., located at Blvr. Louis Pasteur, 47, 110, 29010 Málaga, CIF B24778862 (hereinafter, “Diga” or “the Company”).

Access to or use of the Services implies full and unconditional acceptance of these Terms. If you do not agree, you must refrain from using the platform.


1. Definitions

  • Services: Features provided by Diga, including the creation of AI agents, call management, SIP Trunk, numbering, integrations, and dashboard.

  • User: The natural or legal person who creates an account and uses the platform.

  • User Data: Information provided by the User for the use of the Services (e.g., contact data, processed content, recordings, AI workflows).

  • AI-Generated Content: Responses, texts, decisions, or operations produced by AI models available on the platform.


2. Purpose and scope of the services

Diga provides a SaaS platform that integrates:

  1. AI tools for automation, customer service, lead qualification, and other workflows.

  2. Telephony services (SIP Trunk, numbering, routing, and call management).

  3. Management tools, APIs, and a workspace for teams.

  4. Integrations with third-party applications

Diga may update, modify, or improve the Services reasonably, notifying material changes when necessary.


3. Terms of use

The User agrees to:

  • Use the Services in compliance with applicable law, especially telecommunications regulations, GDPR/LOPDGDD, consumer law, and intellectual property law.

  • Not use the Services for unlawful, fraudulent, abusive, or otherwise contrary-to-these-Terms purposes.

  • Provide truthful data and keep their account information up to date.

  • Implement internal measures to ensure proper use by their team.

Diga may suspend or restrict access if it detects irregular use, security risk, or breach of the Terms.


4. Telephony services


4.1. Service limitations

Diga's telephony Services do not constitute an emergency service (112 or others). The User must have alternative solutions for such purposes.


4.2. Regulation of use

The User agrees not to use numbering or SIP Trunk for:

  • Spam, unauthorized automated campaigns, or abusive practices.

  • Identity theft or caller-ID manipulation.

  • Actions contrary to the guidelines of telecommunications authorities.


4.3. Quality and availability

Quality depends on external factors, such as the User's Internet connection.
Diga will make reasonable efforts to ensure service availability, without guaranteeing absolute uptime.


5. Artificial Intelligence Services


5.1. Nature and limitations

The User acknowledges that AI agents may generate errors, incorrect interpretations, or unexpected results.
The Company does not guarantee the accuracy or suitability of AI-Generated Content.


5.2. User responsibility

The User is responsible for:

  • Reviewing outputs before making significant decisions.

  • Ensuring that the use of AI complies with applicable regulations in their sector.

  • The content generated and its use with third parties.


5.3. Use of data

Data are processed exclusively to provide the Service, improve its operation, and ensure security.
Diga will not use User data to train public models or share data with third parties except where required by law or with necessary providers.


6. Data protection

Data processing shall be governed by:

  • Regulation (EU) 2016/679 (GDPR)

  • Organic Law 3/2018 (LOPDGDD)

Diga will act as:

  • Data controller with respect to account, billing, and support data.

  • Data processor with respect to data processed by the User in their workflows (calls, recordings, integrations…).

The User declares that they have sufficient legal basis to process third-party data entered into the platform, especially in relation to calls and recordings.

A Data Processing Agreement (DPA) forms an integral part of these Terms.


7. Intellectual and Industrial Property

  • All software, design, documentation, and technical elements of Diga are the exclusive property of the Company or its licensors.

  • The User retains ownership of their data, settings, and content.

  • The User warrants that they have sufficient rights to incorporate data or materials into the platform.


8. Plans, pricing, and billing

  • Prices are shown in euros (€) and do not include taxes.

  • Non-payment may result in suspension of the Service after reasonable prior notice.

  • Diga may change prices by giving at least 30 days' notice.

  • The Services may include recurring components (subscription) and variable components (minutes, storage, AI usage).


9. Availability, support, and maintenance

  • Diga will make reasonable efforts to ensure stable availability, except for interruptions due to scheduled maintenance, third-party incidents, or force majeure.

  • The User may contact support through the channels indicated on the platform.


10. Third-party integrations

The Services may link to or interoperate with third-party tools.
Diga is not responsible for failures, changes, or unavailability caused by such third parties.

Use of integrated services shall also be governed by their own terms.


11. Prohibited uses

The User may not use the Services for:

  • Illegal, deceptive, or telecommunications-regulation-contrary activities.

  • Processing sensitive data without sufficient legal basis.

  • Introducing malware, attempting to breach security, or interfering with the infrastructure.

  • Sending commercial communications without complying with applicable regulations (e.g., LSSI).


12. Duration and termination

The User may cancel their account at any time, effective in the next billing cycle.
Diga may terminate or suspend the Services for:

  • Breach of the Terms.

  • Fraudulent or abusive use.

  • Legal requirement.

After termination, Diga will retain only the data strictly necessary for the statutory periods (e.g., billing).


13. Limitation of liability

To the fullest extent permitted:

  • Diga shall not be liable for indirect damages, loss of profits, loss of data, or failures arising from external services.

  • Diga's total liability shall not exceed the total amount paid by the User in the last 12 months.

  • Diga is not responsible for the User's use of AI-Generated Content.

Nothing above limits liability for gross negligence, wilful misconduct, or mandatory legal requirements.


14. Force majeure

Diga shall not be liable for delays or failures resulting from causes beyond its reasonable control (global outages, supplier failures, natural disasters, unavoidable cyberattacks…).


15. Law and jurisdiction

These Terms are governed by Spanish law.
The parties submit to the courts and tribunals of Málaga, except where mandatory law provides otherwise.
